In a recent decision by the Superior Court of New Jersey, Appellate Division, Prinsipe L. Amante’s appeal for accidental disability retirement benefits (ADRB) was denied. Amante, a corrections officer, sustained a knee injury while responding to an emergency distress call. The Board of Trustees of the Police and Firemen’s Retirement System initially denied his application, stating that the incident did not meet the criteria of being “undesigned and unexpected” as per the Richardson standard. Despite an Administrative Law Judge siding with Amante, the Board maintained its stance upon review. The court affirmed this decision, concluding that Amante’s injury occurred during his regular job duties and was not extraordinary or unusual in common experience.
