The case revolves around allegations that UNEX Corporation did not adequately secure and safeguard the personally identifiable information (PII) entrusted to it by its clients. This failure purportedly resulted in a data breach on November 2, 2025, where unauthorized individuals accessed and potentially stole sensitive data including names and Social Security numbers. Despite launching an investigation immediately after discovering the breach, it wasn’t until January 5, 2026, that the company confirmed personal information had been compromised. Impacted individuals were notified about this breach starting February 5, 2026.
Fanelli accuses UNEX Corporation of negligence and other violations such as unjust enrichment and breach of fiduciary duty. She claims that due to inadequate security measures and delayed notification of the breach, affected individuals have suffered financial losses and are at increased risk of identity theft. The lawsuit highlights how these failures have caused irreparable harm by exposing private information to potential misuse on platforms like the dark web.
The plaintiff is seeking several forms of relief from the court.
