Plaintiff Accuses Property Management Companies of Negligence and Discrimination

Linda A. Evans, a New Jersey resident, has filed a compelling lawsuit against her landlords for failing to address hazardous living conditions that have exacerbated her health issues. On February 19, 2026, Evans lodged her complaint in the United States District Court for the District of New Jersey against Paramount Properties Land VIII LLC., Paramount Homes LLC., and Paramount Escapes Ocean Breeze.

Evans moved into her Barnegat residence on July 1, 2023, under the impression it was newly constructed. However, she soon discovered water leaks and mold issues that were not adequately addressed by the defendants. Despite being a disabled individual with asthma and severe allergies—conditions protected under the Americans with Disabilities Act (ADA)—Evans claims her requests for necessary repairs were ignored or inadequately handled. “The mold and water leaks were just one incident,” Evans states in her complaint, highlighting ongoing neglect and breaches of duty by the property owners.

In addition to negligence, Evans accuses the defendants of breaching their lease agreement by failing to maintain safe living conditions as required by law. She alleges that maintenance requests were ignored or superficially addressed, leading to persistent mold problems that threatened her health. The lawsuit also details instances of alleged harassment by employees of the defendants, including inappropriate surveillance and sexual harassment by a maintenance supervisor.

Evans is seeking compensatory damages for financial losses incurred due to medical expenses and efforts to improve her living conditions. She demands equitable relief such as reinstatement to rightful place and injunctive relief barring future discriminatory conduct. Her claims include violations of the Fair Housing Act (FHA), New Jersey Law Against Discrimination (LAD), breach of contract, negligence, and violation of the ADA.

Represented by attorney Marc A. Weinberg from Saffren & Weinberg law firm, Evans is determined to hold her landlords accountable for their actions. The case is presided over under Case ID 3:26-cv-01651 in front of judges yet unnamed.
