Alberto has filed a lawsuit against the Bergenfield Board of Education, Superintendent Dr. Christopher Tully, and Board President Dr. Joseph Amara in the United States District Court for the District of New Jersey. The complaint alleges violations of her First and Fourteenth Amendment rights under the U.S. Constitution. Dr. Alberto claims that her salary was unlawfully reduced without due process during an approved sabbatical leave and that she was silenced at a public meeting for criticizing board governance, which she argues constitutes viewpoint discrimination. The lawsuit seeks declaratory and injunctive relief, compensatory and punitive damages, as well as attorney’s fees.
