The case, filed in the United States District Court for the District of New Jersey, accuses the defendants of engaging in racketeering activities under the Racketeer Influenced and Corrupt Organizations Act (RICO), alongside claims of insurance bad faith, fraud, civil conspiracy, and obstruction of regulatory processes.

Kovacs alleges that these entities operated an interstate racketeering enterprise designed to systematically deny legitimate insurance claims. He asserts that Allstate and GNY colluded to create false coverage exclusions and obstructed justice by concealing evidence during state court proceedings. The complaint details how Allstate initially approved a claim for water damage to Kovacs’ condominium unit but later denied it, directing him instead to seek payment from GNY despite their policy excluding such coverage.

The lawsuit highlights multiple alleged acts of mail and wire fraud, claiming that fabricated denials were transmitted via interstate communications. Kovacs seeks treble damages, injunctive relief, and attorney’s fees under RICO statutes.
