In a recent decision by the Superior Court of New Jersey, Appellate Division, plaintiff Gina Marie Battaglini’s appeal was dismissed in a case involving breach of contract claims against defendants Andrew Hartung and Range Rover. The case revolved around an alleged failure to honor an automobile repair warranty for a Land Rover Discovery purchased by Battaglini. Despite the vehicle being under warranty, the court found that water damage from an external source caused the radio malfunction, thus voiding the warranty claim. The trial court’s decision was upheld due to credible testimony from Carlos Santiago, a certified mechanic, who inspected the vehicle and reported finding water damage unrelated to manufacturing defects. The appellate court confirmed there was no evidence supporting Battaglini’s claims against Hartung personally or proving that the dealership breached its warranty obligations.
