In a recent decision by the Superior Court of New Jersey, Appellate Division, Dairyland USA Corporation, operating as Chefs’ Warehouse, successfully compelled arbitration in a dispute with former employee Francois D’Anjou. The case revolves around D’Anjou’s claims under the New Jersey Conscientious Employee Protection Act and the New Jersey Law Against Discrimination. Chefs’ Warehouse had filed an order to show cause to compel arbitration based on an agreement allegedly signed by D’Anjou. He contested the validity of his electronic signature, arguing it was computer-generated and not authentic. However, the court found substantial evidence supporting that D’Anjou had accessed and signed the agreement through secure company systems requiring unique passwords and multi-factor authentication. Consequently, the court affirmed the decision to compel arbitration without holding a plenary hearing.
